El proppassat dia 31 d\u2019agost es va aprovar el <strong>Real Decret-Llei d\u2019urg\u00e8ncia 11\/2018<\/strong> publicat en el BOE en data 4 de setembre de 2018 als efectes d\u2019aprovar la transposici\u00f3 de la quarta &nbsp;Directiva Europea n\u00famero 2015\/849 del Parlament Europeu i del Consell de data 20 de maig de 2015 que tracta aquesta mat\u00e8ria, recordem aquesta Directiva modificava la Llei 10\/2010 de Prevenci\u00f3 del Blanqueig de Capitals i de Finan\u00e7ament del Terrorisme.<\/p>\n<p><strong><em>Perqu\u00e8 \u00e9s aprovat d\u2019urg\u00e8ncia?<\/em><\/strong> Per incorporar sense m\u00e9s dilacions, el nostre ordenament jur\u00eddic espanyol a la normativa europea i la finalitat d\u2019aquesta unificaci\u00f3 normativa \u00e9s, principalment, addicionar obligacions, a les ja establertes, a la llei espanyola en mat\u00e8ria de llic\u00e8ncia o registre dels prestadors de serveis a societats, endurir el r\u00e8gim sancionador i regular els diferents canals de den\u00fancia aportant una major protecci\u00f3 de les persones.<\/p>\n<p><strong><em>Amb quins objectius?<\/em><\/strong><\/p>\n<p>Refor\u00e7ar l\u2019obligaci\u00f3 de prendre <em>mesures de diligencia refor\u00e7ades<\/em> respecte aquells pa\u00efsos que la Comissi\u00f3 Europea llistar\u00e0 i publicar\u00e0.<\/p>\n<p>Tanmateix, es redefineix el concepte de <em>Persones de Responsabilitat P\u00fablica (PRP)<\/em> desapareixent la distinci\u00f3 entre internacional i nacional. El RDL aprovat detalla les persones que s\u2019inclouen en aquesta figura i regula les seves obligacions.<\/p>\n<p>Un altre objectiu important i, que afecta especialment, als comerciants de b\u00e9ns que fan \u00fas &nbsp;de l\u2019efectiu com a mitj\u00e0 de pagament, \u00e9s l\u2019obligatorietat per aquests casos, d\u2019acomplir amb les obligacions de prevenci\u00f3 del blanqueig de capitals que baixen de 15.000 euros a 10.000 euros.<\/p>\n<p>Com coment\u00e0vem al inici, s\u2019endureixen les sancions adaptant els nivells m\u00e0xims establerts per la UE i incorporant noves regles en mat\u00e8ria de publicitat definint tamb\u00e9 nous tipus infractors. Es modifica el import m\u00e0xim possible de les sancions a imposar en cas d\u2019incompliment de les obligacions de prevenci\u00f3.<\/p>\n<p>Respecte els <em>canals de den\u00fancia<\/em>, l\u2019objectiu de la nova norma, \u00e9s definir un sistema de comunicaci\u00f3 o den\u00fancia d\u2019aquelles infraccions que tinguin car\u00e0cter confidencial.<\/p>\n<p>Es regula la creaci\u00f3 d\u2019un <em>nou registre de prestadors de serveis<\/em> a societats ampliant els prestadors de serveis a fide\u00efcomisos. Important remarcar coma novetat, que totes aquelles persones f\u00edsiques o jur\u00eddiques que prestin serveis, ja sigui de forma empresarial o professional, respecte les activitats relacionades a la llei, hauran d\u2019inscriure\u2019s, pr\u00e8viament al inici de les seves activitats, en el Registre Mercantil competent. Seguidament es regula diferents especificacions al respecte.<\/p>\n<p>Les persones jur\u00eddiques a m\u00e9s, com a novetat, hauran de presentar una manifestaci\u00f3 de qui s\u00f3n els seus titulars reals en el Registre Mercantil.<\/p>\n<p>Per \u00faltim, tamb\u00e9 a remarcar, es mant\u00e9 l\u2019obligaci\u00f3 de <em>conservar la documentaci\u00f3<\/em> per un termini de 10 anys per\u00f2, com a novetat, un cop transcorreguts 5 anys des del cessament de la relaci\u00f3, la documentaci\u00f3 guardada, nom\u00e9s ser\u00e0 accessible per aquells \u00f2rgans de control intern o els encarregats de la seva defensa legal.<\/p>\n<p>Per m\u00e9s detall i informaci\u00f3, contactin amb nosaltres.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Prevenci\u00f3 del Blanqueig de Capitals&#8230; Tenim novetats?
