Informem sobre la recentment publicada Llei de l’Habitatge (Llei 12\/2013 de 24 de maig) en el Butllet\u00ed Oficial de l’Estat (BOE). Aquesta llei va entrar en vigor el 26 de maig de 2023.<\/p>\n\n\n\n

Assenyalem que algunes disposicions no s’aplicaran immediatament, com la definici\u00f3 de les zones tibants, i altres, com els incentius fiscals, que entraran en vigor al gener de 2024.<\/p>\n\n\n\n

Aquestes s\u00f3n les disposicions que ja estan en vigor:<\/p>\n\n\n\n

    \n
  1. Informaci\u00f3: s’amplia el dret a rebre informaci\u00f3 b\u00e0sica sobre un habitatge en comprar o llogar, quan l’interessat el sol\u00b7liciti.<\/li>\n\n\n\n
  2. Honoraris de contractes: les despeses de gesti\u00f3 immobili\u00e0ria i els de formalitzaci\u00f3 de contracte seran responsabilitat de l’arrendador<\/li>\n\n\n\n
  3. Definici\u00f3 de Gran Tenedor: es considera Gran Tenedor a qui posseeix m\u00e9s de 10 immobles residencials o una superf\u00edcie constru\u00efda de m\u00e9s de 1.*500m\u00b2. Les Comunitats Aut\u00f2nomes podran considerar Gran Tenedor a qui tingui 5 o m\u00e9s habitatges en zones tibants.<\/li>\n\n\n\n
  4. Actualitzaci\u00f3 de la renda: es limita l’increment m\u00e0xim de la renda en contractes de lloguer fins a 2024, de manera que, fins al 31\/12\/2023 la limitaci\u00f3 de l’increment m\u00e0xim \u00e9s del 2% i en 2024 ser\u00e0 del 3%. A partir de 2025, s’utilitzar\u00e0 un nou \u00edndex de revisi\u00f3 de l’Institut Nacional d’Estad\u00edstica.<\/li>\n\n\n\n
  5. Durada i pr\u00f2rrogues dels contractes: s’estableixen noves pr\u00f2rrogues per a contractes d’arrendament en casos d’arrendataris vulnerables i zones tibants.<\/li>\n\n\n\n
  6. Desnonaments: en les demandes de desnonament s’especificar\u00e0 si l’habitatge \u00e9s la resid\u00e8ncia habitual de l’arrendatari, si el propietari ho \u00e9s, o no, gran tenedor i si es va intentar pr\u00e8viament un procediment de conciliaci\u00f3 o intermediaci\u00f3.<\/li>\n<\/ol>\n\n\n\n

    Pel que fa a les disposicions que encara no estan vigents trobem:<\/p>\n\n\n\n

      \n
    1. Limitaci\u00f3 de rendes: les limitacions de renda en zones tibants s’aplicaran quan es declarin oficialment i s’aprovin els nous \u00cdndexs de Refer\u00e8ncia.<\/li>\n\n\n\n
    2. Zones tibants: les autoritats competents iniciaran el proc\u00e9s de declaraci\u00f3 de les \u00e0rees considerades zones tibants.<\/li>\n\n\n\n
    3. Incentius fiscals: els incentius fiscals, incloent-hi reduccions en l’impost sobre la renda, entraran en vigor a partir de gener del 2024.<\/li>\n<\/ol>\n\n\n\n

      \u00c9s important destacar que la nova llei presenta defici\u00e8ncies i confusions en la seva redacci\u00f3. Igualment, el nou panorama pol\u00edtic despr\u00e9s de les eleccions del 28 de maig de 2023, posa en reserva l’aplicaci\u00f3 pr\u00e0ctica de les disposicions iniciades, especialment en aquelles que encara no estan vigents.<\/p>\n\n\n\n
